Informational Returns

If you own an entity outside the US, you might have "Informational Return" filing requirements. The reason it is called informational is that these type of returns do not necessarily impact your tax amount; they are just informing the IRS about your foreign assets. Failing to do so on-time, however, has one of the highest penalties imposed by the IRS.

These are some of the Informational Return filing requirements that you might have:
  • Form 5471: If you are a shareholder in a foreign corporation
  • Form 8865: If you are a partner in a foreign partnership
  • Form 8858: If you own a foreign disregarded entity
  • Form 3520-A: If you are a grantor to a foreign (non-US) trust
  • Form 3520: If you are a beneficiary in a foreign trust
  • Form 8938: If you have interest in specified foreign financial assets
